I am not sure if it's a queen but i am sure it's not lasius niger :D..

I guess it'd be a Formica Sanguinea. I am not an expert but help me find out if it's a Queen.

It also looks to me like formica sanguinea I will continue to search for further alternatives, however.
As always, wishing you well on your exciting ant adventure, Ants the Lowcountry.

i have checked all spiecies in my country. Formica Rufa has something like black cap on her body, corps. Check the Formica Singuinea it looks like this i think.

If its a queen?
I'd be soo happy if it was true but i read something that she steals larvay from other nest to start her own does it mean she can't start layin eggs?

If she happens to be a parasitic queen she is capable of laying eggs but she cannot care for them without help from workers of her host colony.

So what do you suggest me to do. I've posted the photo of worker. Would it be safe if i put her to the queen? I caught the warker in the not far away from the place i found the queen. Probably they are from the same nest

Unlikely. They need workers from a specific host colony which you would have to identify and introduce to her or the pupae from that colony. Getting the wrong one will lead to her death. That's all if she's parasitic. I don't know whether or not she is.
