Can Prenolepis Imparis ants be black/dark brown?

I have a queen ant who I am a bit unsure of and I am making thinking that it might be a prenolepis ant as she is laying eggs even though it is winter... However, she is not light brown/orangiesh as prenolepis ants so I am wondering if they can also be black. Here is a clip of my queen ant.

Late august or early september in Virginia (USA)

Based on that I would guess Lasius sp. or Crematogaster sp. but I would wait for a more experienced person to identify them, like batspiderfish. Definitely not Prenolepis imparis if you caught her in September/August.

Here is another video taken from the side angle. Her wings are bent for some reason and won't come off. Thanks for the help so far! :)

Prenolepis imparis can be dark brown like mine, but they fly from January-May, and your's doesn't look like a Prenolepis imparis queen, so it's most likely Formica sp.
